Terms and Conditions of Use

The Service is currently operated by Francesco Paolo Miceli, a private individual, as the owner and person responsible for the Fanta Best project.

The owner reserves the right to update their legal status (e.g. incorporation of a company) at a later stage. In that case these Terms will be updated with the new identifying details (company name, registered office, VAT number), while the rest of the document's content remains unchanged unless expressly stated otherwise.

Fanta Best is a fantasy-sport platform based on predicting sporting results (the "slip"), letting users compete inside private leagues (created among friends or acquaintances via an invite code) or Special Leagues (organised in partnership with third-party sponsors). The Service does not involve managing squads, line-ups or footballing skill: scoring is based solely on the accuracy of predictions and their relative difficulty (odds).

The Service is in no way a real-money betting platform. There is no mandatory payment required to take part in the base game, nor any cash prize paid out directly by Fanta Best.

• Access to the Service is only permitted to users who are at least 18 years old. Registration requires an explicit declaration of legal age.
• Registration can take place by creating a dedicated account or by authenticating with a Google account (OAuth). In both cases, before the account is activated, the user must explicitly confirm acceptance of these Terms and of the Privacy Policy.
• The user undertakes to provide truthful data and keep it up to date. Fanta Best reserves the right to suspend or delete accounts registered with false data, including untruthful age declarations.
• Each user may hold only one personal account. Creating multiple accounts or transferring an account to a third party is not permitted.

The detailed workings of the game — creating and managing leagues, generating the head-to-head schedule, filling in the slip, calculating the odds score and home bonus, converting scores into goals and determining winners — are governed by the Game Rules, an integral part of these Terms and available inside the App.

• The odds used to calculate scores are supplied by a third-party service (The Odds API) and are captured as a "snapshot" when each matchday's slip opens; they are not subject to later changes.
• Fanta Best does not guarantee the accuracy, continuous availability or timeliness of sporting data and odds supplied by third-party providers, and is not liable for any errors, delays or interruptions in their transmission.
• Each league's administrator ("captain") is responsible for managing invites and for deciding when to start the schedule via the relevant function; that decision is irreversible and closes registrations to the league.

Fanta Best offers additional paid features ("Plus"), available in two forms: Account Plus (for the individual user) and League Plus (for a league as a whole). Both options last only for the current sporting season (until the end of the relevant championship) and do not renew automatically.

• The price, included features and purchase method for each Plus option are shown inside the App at the time of purchase.
• For the current season, Fanta Best reserves the right to make available discount codes that reduce the cost of Account Plus and/or League Plus to zero, including as a reward for achieving certain in-game results. Using such codes does not change the nature of the service, which remains governed by these Terms.
• In the absence of actual payments, no refund conditions currently apply; should an actual price be introduced in future, the Terms will be updated with the relevant withdrawal and refund conditions in accordance with applicable distance-contract consumer law.

Special Leagues are a game format designed for sponsors and large communities, with no maximum number of participants and no head-to-head schedule, ranked solely by odds score.

• Fanta Best provides the game platform and the mechanism for calculating Special League standings, but is not a party to the relationship between the sponsor and participants regarding the delivery of any prizes.
• Unless otherwise specified, organising a Special League, communicating its participation conditions and delivering any related prizes are the sole responsibility of the sponsor promoting it, under a separate written agreement between the sponsor and Fanta Best.
• Fanta Best does not guarantee, and is not liable in any way for, the actual delivery of prizes promised by a sponsor, nor for the compliance of related promotional communications with applicable law (including provisions on prize competitions, where relevant).

The name "Fanta Best", the logo, the tagline, the graphic interface, the texts and every other distinctive element of the App belong to Francesco Paolo Miceli or are licensed to Fanta Best, and are protected under applicable intellectual property law. Reproducing, distributing or modifying these elements without written authorisation is prohibited.

User-generated content (e.g. username, league name) remains at the user's disposal; the user grants Fanta Best a non-exclusive licence to display it within the Service, to the extent necessary for the game to work.

When using the Service, the user undertakes to:

• not create fake or multiple accounts, nor attempt to manipulate results or standings;
• not use the Service for unlawful purposes or in violation of third-party rights;
• behave correctly and respectfully towards other participants, particularly within shared leagues;
• not attempt to gain unauthorised access to the systems, data or accounts of other users.

Breaching these rules may lead to the suspension or deletion of the account, at Fanta Best's unquestionable discretion, without prejudice to the user's right to request clarification through the contact channels indicated.

• The Service is provided "as is", without warranties of continuity, error-free operation or fitness for a particular purpose, to the extent permitted by applicable law.
• Fanta Best is not liable for interruptions to the Service due to maintenance, technical failures, unavailability of third-party providers (including sporting-data and odds providers) or force majeure.
• To the maximum extent permitted by law, Fanta Best's overall liability towards the user, for any cause connected with use of the Service, shall not exceed the amount, if any, paid by the user for Plus services in the 12 months preceding the event giving rise to liability.
• This does not affect Fanta Best's liability for wilful misconduct or gross negligence, in cases where the law does not allow it to be limited.

Fanta Best reserves the right to modify, suspend or discontinue, in whole or in part, the Service's features, as well as to update these Terms. Substantial changes will be communicated to users via the App or by email with reasonable notice before they take effect. Continuing to use the Service after such changes are communicated constitutes acceptance of the new Terms.

• The user may delete their account at any time using the features available in the App or by contacting develop@fantabest.app.
• Fanta Best reserves the right to suspend or delete accounts in the event of a breach of these Terms, with notice to the user except in cases of serious or repeated breach.
• Deleting an account results in the removal of personal data as described in the Privacy Policy, subject to any retention obligations required by law.

These Terms are governed by Italian law. For any dispute relating to the interpretation, performance or validity of these Terms, where the user qualifies as a consumer, the competent court will be that of the user's place of residence or domicile, pursuant to applicable consumer-protection law.
